The couple's arranged marriage was solemnized in 2018, according to assertions from the husband’s legal representative. However, the marriage faced turbulence shortly after the wife discovered that her sister-in-law had married a person from a different community, which the wife perceived as being lower in the societal hierarchy. This revelation emerged merely two days after she had returned to her marital home, leading to considerable distress. In 2020, prompted by her feelings of cruelty stemming from this situation, she sought a divorce in the Bhavnagar family court, articulating her claim that her husband had withheld critical information regarding his family's marital choices.
In her petition, she highlighted that while her husband had mentioned he had two sisters, he failed to disclose the existence of a third sister who had contracted a marriage outside their caste. This realization hit her when she encountered this third sister at a wedding, a situation that further intensified her feelings of betrayal. The wife's grievances extended beyond familial concealment; she also asserted that her husband had filed a police complaint against her family, alleging threats to his safety, and had inappropriately sent this communication to her workplace, adding to her sense of distress.

Desai concluded that an examination of the judgment and decree in question revealed that a principal argument made by the wife in her favor was centered around her claim of cruelty, which was significantly attributed to the inter-caste marriage of her husband's sister. Following the issuance of a notice to the wife regarding the appeal, the High Court has earmarked January 20 for a joint hearing to deliberate on both appeals.
