Shocking Twist! Supreme Court Grants Bail to Delhi CM Arvind Kejriwal in High-Stakes CBI Case!
The Court pronounced the verdict in the petitions filed by Delhi Chief Minister Arvind Kejriwal challenging his arrest and seeking bail in the case registered by the Central Bureau of Investigation (CBI) over the alleged Delhi Liquor Policy scam. A bench of Justices Surya Kant and Ujjal Bhuyan had heard the matter and reserved verdict on September 5. Both the judges delivered separate judgments.
Justice Surya Kant held that the arrest of Kejriwal was legal and did not suffer from any procedural irregularity. He rejected the claim that the CBI had failed to comply with the mandate of Section 41 of the Code of Criminal Procedure. However, both judges agreed to grant bail to Kejriwal, noting that the chargesheet had been filed, and the trial would not be concluded in the near future. Kejriwal is prohibited from visiting the Chief Minister’s office and Delhi Secretariat unless clearance is obtained from the Lieutenant Governor of Delhi.
While Justice Kant upheld the arrest, Justice Bhuyan questioned the necessity of the arrest, suggesting that it was carried out to frustrate the bail granted to Kejriwal in the money laundering case. He emphasized that the CBI had not arrested Kejriwal for 22 months but acted only after the trial court granted him bail in the ED case, raising doubts about the CBI's urgency in the arrest.
Justice Bhuyan also expressed reservations regarding the bail condition that prohibits Kejriwal from visiting the CM's office and the Secretariat but refrained from issuing a direction out of respect for judicial discipline. He reminded the CBI of its duty to conduct fair investigations, stressing the importance of public perception in maintaining trust in democratic institutions.
Kejriwal's petition challenged the Delhi High Court's dismissal of his plea against his CBI arrest, which allowed him to seek bail from the trial court. Kejriwal was formally arrested by the CBI on June 26, 2024, while already in ED custody for the money laundering case related to the liquor policy scam. Despite receiving interim bail in the ED case, Kejriwal remained in custody due to his CBI arrest.
Other co-accused in the liquor policy case, including Manish Sisodia, K Kavitha, Vijay Nair, and Sanjay Singh, were granted bail by the Supreme Court earlier this year. The Delhi High Court also recently granted bail to Sameer Mahendru, Chanpreet Singh, and Arun Pillai.
